What next?

I got a call from an attorney because someone from my kids' Spanish class is sueing Phoenix Parks and Rec, because a water fountain over sprayed and the woman slipped and fell on the wet ground. Does someone really have to be sued for this?

The woman must have been embarrassed and maybe even got bruised up, or broke something and I would think the City of Phoenix has ways to cover that, but to sue beyond that seems self-serving and far reaching. I don't know what she is seeking, but it would lead to an increase in cost of insurance I am sure, then a committee would have to decide if they need to do away with water fountains or find ones that don't overspray, (time and money) for a situation that could have been avoided had SHE been paying better attention to where she was walking.

Am I wrong or is this a system (and society) gone amok?

just curious...why is an attorney calling you? Is the attorney that contacted you representing the woman who fell or the city?

Did the attorney mention why this individual is looking to suing the city?

I agree there are times when things happen that individuals file frivolous lawsuits and there seems to be more and more each day. But i am not sure what all the details are in this case - i'd be curious to know more.

The attorney called me because I was at the class and in the vicinity when it happened, and had I seen anything? I don't have a strong recollection except someone slipped and then got up. It didn't seem like anything out of the ordinary at the time. Although the attorney didn't mention if she was representing the city or the woman, she was asking questions like "Was there any signs stating that the area might be wet?" "Have you seen any signs like this since?"

I'd be curious to know more too, but since I really had no new insights, I doubt I'll be asked anything further. There was no emergency vehicles called to the scene, at least not while I was still there, and with wrangling my 2 year olds, I don't get out very quickly. There wasn't a malfuntion with lots of water running down the hall, or my girls would have been splashing in it in a second! So, I don't think there was any unusual circumstances, except this one person fell, no one else did.

Cripes. Once you're an adult, don't you know to step carefully on wet or icy concrete? Stuff happens, and one needs to take reasonable steps not to put him/herself in a position to get hurt.

There are so many people out there who are just looking to sue for anything and everything and then you have the lawyers who are ambulance chasers who will take any case whether or not it could be solved amicabally between both sides involved. In this day and age everything seems to have a price tag on it even injuries .... yep things like this definitely contribute to insurance rate increases ..... I can see if the lady ended up having life threatening injuries or was completely incompasitated ... but if you're just dealing with a few bumps and bruises and nothing that's going to jeaparodize the rest of your life then deal with it .... I'm sure the city would have been more than willing to pick up the medical bills .....although then you run into the situation where you don't know both sides of the story and whether or not the city of Phoenix is refusing responsibility and refusing to pay medical costs ... which when that comes into play and you're ending up having to pay out of pocket costs then it might be rightly so to file a law suit ...it's hard to say with out knowing both sides of the story .... but there are indeed people out there that are sue happy and just waiting for something to happen to make a buck!!

No doubt about it, we live in a "sue happy" society. I was sued by a "friend" over a house sale gone bad. It was the most stressful thing I have ever gone through and to make matters worse, I was pregnant at the time. No whenever my kids refer to suing somebody in a flippant matter, I set them straight about lawsuits and how they should be avoided at all cost.
